Terms and Conditions

1. This competition (Competition) is conducted by Liberty Financial Limited (Company Number 657409) (Promoter).

2. The Competition begins on Tuesday, 18 February 2025 at 8:00am (NZST) and closes on Monday, 24 March 2025 at 5.00pm (NZST) (Competition Period).

3. This Giveaway Competition is open to individuals who:

a) are New Zealand residents;

b) are aged 18 years or older

c) have not breached these Terms and Conditions; and

d) are not ineligible under clause 4, which applies to individuals with certain existing relationships to us,

together the “Eligible Entrants”.

4. Employees (and their immediate families) of the Promoter or its related entities, or of any other organisation associated with this Competition (for example, prize suppliers associated with this Competition) are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin. Related entity means related within the meaning of the Companies Act 1993.

How to Enter:

5. To enter, Eligible Entrants must respond to the competition email sent to them by one of our BDMs or by completing an entry form at the Kiwi Adviser Network (KAN) conference on 18 and 19 February 2025 with one sentence about what excellence in the mortgage industry means to them, before Monday, 24 March at 5.00pm (NZST).

6. Multiple entries are not permitted.

7. All entries must be submitted by a natural person, and automated entries, unauthorised entries and/or entries by persons using an alias are invalid.

Prize Draw and Winner Notification

8. The Promoter shall draw two prize winners at 10:00am on Wednesday, 26 March 2025.

9. The draw will be made at random from all eligible entries.

10. The Promoter shall notify the winner by email or telephone and may publish the winner’s first name/s on the Promoter’s LinkedIn and/or other social media pages.

11. The winner must accept the prize by 5:00pm Wednesday 2 April 2025 by responding to the email or answering the phone call. If the winner has not accepted the prize by this time, the prize is forfeited, and a new winner will be drawn and contacted in accordance with clauses 8-10.

The Prize

12. Each prize is one ticket to the New Zealand Mortgage Awards event to be held at the Auckland War Memorial Museum on 10 April 2025 6.30pm-9.30pm, valued at $172.50.

13. The prize (or any unused portion of the prize) is not transferable, exchangeable or redeemable for cash. The prize must be taken as offered and may not be varied.

14. The Promoter, in its discretion, reserves the right to substitute the prize with another prize to the equal value and/or specification if the prize is unavailable, or subject to any requests from a regulatory authority.

15. The winner is responsible for understanding and complying with their taxation obligations in relation to the prize.

16. The Promoter is not responsible for travel or accommodation costs associated with attending the New Zealand Mortgage Awards event. 

17. By entering this Competition, Eligible Entrants agree they will take all reasonable steps requested by the Promoter to enable delivery of the prize.

Miscellaneous Provisions

18. Participation in this Competition is subject to these Terms and Conditions.

19. The Promoter’s decision not to enforce a specific restriction does not constitute a waiver of that restriction or of these Terms and Conditions generally.

20. Each Eligible Entrant acknowledges that the Promoter can rely on these Terms and Conditions even if the Promoter only learns of an Eligible Entrant’s ineligibility to enter after the Promoter has awarded a Prize to the ineligible entrant. Return of a Prize or payment of its equivalent value to the Promoter can be required by the Promoter if this occurs.

21. All Eligible Entrants consent to the Promoter, and the Promoter’s related entities using their information for the following purposes in addition to the conduct of the Competition:

a) Promotion of products and services, including products or services that we distribute; and

b) Conducting research, and planning or developing product and marketing strategies.

22. By accepting the prize, winners consent to the Promoter and its related companies using their name, and image in the event they are the winner (including photograph) in any media for an unlimited period without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.

23. If for any reason this Competition is not capable of running as planned for any reason, including without limitation technical failure, tampering, unauthorised intervention, fraud, or any other matter beyond the control of the Promoter, which corrupt or affect the administration, security, fairness or integrity or proper conduct of this Competition or the reputation of this Competition or that of the Promoter, the Promoter may cancel, terminate, modify or suspend this Competition.

24. The Promoter reserves the right, at any time, to verify the validity of entries and the Eligible Entrants (including their eligibility to enter) and to disqualify any entrant whose entry is not in accordance with these Terms and Conditions, who interferes improperly in the administration, integrity or conduct of the Competition or who otherwise tampers with the entry process. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.

25. Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees provided by law.

26. Except for any liability that cannot by law be excluded, the Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:

a) any technical difficulties or equipment malfunction (whether or not under the Promoters control);

b) any theft, unauthorised access or third party interference;

c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;

d) any tax liability incurred by a winning entrant; or

e) acceptance or use of a prize.

27. This competition is in no way sponsored, endorsed, administered by or associated with LinkedIn.

28. The laws of New Zealand apply to this Competition to the exclusion of any other law. All Eligible Entrants submit to the exclusive jurisdiction of the courts of New Zealand.

29. The Promoter’s decisions in relation to this Competition are final and the Promoter reserve the right to not respond to any communication disputing or disparaging their decisions.

Privacy

30. When an Eligible Entrant enters this Competition, the Promoter may collect the personal information the Eligible Entrant provides. If the Eligible Entrant wins the Competition, the Promoter may collect further information about them.

31. The Promoter may use the information provided by the Eligible Entrant to administer the Competition, fulfil the prize and to promote their products and services and those of their partners.

32. Without some or all of this information, the Eligible Entrant may not be able to participate in the Competition or receive the prize.

33. The Promoter may disclose the entrant’s personal information to:

a) Entities who assist the Promoter in administering the Competition and fulfilling the prize, and other prize suppliers and deliverers;

b) Marketing, research, and communications agencies;

c) Its related companies, who will use and disclose it for similar purposes as the Promoter’s

d) The authorities responsible for the regulation of gaming and lotteries and other government agencies, where applicable; and

e) Other parties where required by law.

34. The Promoter may disclose the personal information it collects in the course of this Competition to its service providers who may store the information, or to the Promoter’s related entities to perform operational or administrative services on the Promoter’s behalf.

35. The Promoter and its related companies will manage the Eligible Entrant’s information in accordance with the Liberty Privacy Policy. This policy explains how to request access to and correct or update information the Promoter holds about the Eligible Entrant, how to raise a complaint about privacy and how the Promoter will deal with a complaint.
